The Catalan Department of Labour, Social affairs and Family has pointed out that the publication and circulation of these images is an violation of the right to honour, privacy and their own image of the underage victims
The Director General of Infants and Adolescents of the Department of Labour, Social Affairs and Family has sent a letter to the Spanish royal household requesting them to withdraw the photographs of the underage victims of the attack on Barcelona and Cambrils from the social media and their website. The department reminded them that the publication and circulation of these images are a violation of the right of these children to their right to honour, privacy and their own image.
They add that the use of infants who have undergone traumatic experiences is expressly prohibited by the legislation protecting infants and adolescents. Specifically, Law 14/2010 on the rights and opportunities of infants and adolescents provides that one must “protect infants and adolescents form the broadcast of their personal data, the broadcasting of images that violate their dignity and the economic exploitation of their image”. Furthermore, said article provides that the public entities must care very especially for the right to intimacy and honour of infants and adolescents “especially those who have been victims of sexual aggression, abuse or any other traumatic experience”.
These principles are also consecrated in Article 16 of the UN convention on the rights of the child: “No child shall be subjected to arbitrary or unlawful interference with his or her privacy, family, home or correspondence, nor to unlawful attacks on his or her honour and reputation. The child has the right to the protection of the law against such interference or attacks”.
Last week, the department also brought a similar claim before the state children’s special attorney regarding the broadcasting of images of the underage victims of the attacks in Barcelona and Cambrils. Likewise, the CAC (Catalan Audiovisual Ruling Body) and the Journalist association of Catalonia also reported the broadcast of this type of images.
